Energy Conservation Construction Code

Summary: New York's Energy Conservation Construction Code (ECCCNYS) is mandatory statewide for both residential and commercial buildings.  The residential code is based on the 2004 IECC with amendments, while the commercial code is based on the 2003 IECC and references ASHRAE 90.1-2004.  As of September 2009, the Department of State’s Office of Counsel is in the process of reviewing rulemaking documents for adoption of the Building Energy Codes indentified in the American Recovery and Reinvestment Act of 2009, (ARRA) Section 410, Additional State Energy Grants. These documents will soon be sent to the Governor’s office of Regulatory Reform for their review.  It is anticipated that the New York State Rulemaking for the Building Energy Codes identified in ARRA will be completed in early 2010.
